In plain English: You are subscribing to a managed platform, not buying software. You own your content. You are responsible for what you publish. We are responsible for the infrastructure. Neither of us is responsible for the other's mistakes. Contact us before going to your bank.
1. Acceptance of Terms
By accessing automatehorizon.com or using any Automate Horizon service (including theme subscriptions, managed hosting, custom build upgrades, and the Horizon Pulse platform), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you may not use our services.
2. What You Are Purchasing
When you subscribe to Automate Horizon, you are purchasing a monthly licence to access and operate an Automate Horizon theme on our managed hosting infrastructure. You are not purchasing, and do not own, the theme software, source code, or any intellectual property associated with it.
The Automate Horizon theme is purpose-built to function as a controller layer for our proprietary platform. It is directly and specifically configured to interface with Automate Horizon’s systems, handling provisioning, subscription management, content gating, and distribution. The theme does not function as a standalone website template outside of our infrastructure.
Your content is always yours. Posts, pages, and media you create can be exported at any time using WordPress’s standard export tool. The theme, source code, and platform integrations are not exportable and remain Automate Horizon’s intellectual property.
If your subscription lapses or is cancelled, your site will be taken offline after a 30-day grace period. During that period your content export remains available.
3. Intellectual Property
All Automate Horizon themes, software, platform code, and proprietary systems are and remain the exclusive intellectual property of Automate Horizon. This includes any customisation work carried out on your behalf. Custom builds are a service fee for labour, not a transfer of IP ownership.
All premium plugins, agency licences, and third-party software provided as part of your subscription are provided under Automate Horizon’s agency or developer licences. You do not own these licences. If you cancel your subscription or migrate off our infrastructure, you are responsible for purchasing your own individual licences to maintain equivalent functionality.
Permission is granted to use the materials on our website for personal, non-commercial viewing only. You may not modify, copy, reproduce, republish, decompile, reverse-engineer, or redistribute any Automate Horizon materials or software.
4. Subscription & Billing
Subscriptions are billed monthly on a recurring basis via CCBill, LLC. Your subscription renews automatically until cancelled. Full terms governing billing, refunds, and cancellation are set out in our Refund & Cancellation Policy, which forms part of these Terms.
5. Payment Processing
a. Mandatory Gateway: To ensure stability in a high-risk industry, all transactions on Automate Horizon sites are processed through CCBill. By using our services, you agree to comply with CCBill’s terms of service and acceptable use policies.
b. Gateway Approval: CCBill account approval is subject to their own underwriting process. Denial of a CCBill account does not constitute grounds for a refund of any Automate Horizon subscription or custom build fees.
c. Limitation of Liability: We are not responsible for delays, denials, holds, or other issues arising from CCBill or any third-party payment provider.
6. Content Responsibility & Age Verification
a. Your responsibility: You are solely and fully responsible for all content published on your Automate Horizon site. Automate Horizon provides infrastructure only. We do not produce, review, or endorse your content.
b. Age Verification obligation: If your site displays sexually explicit content, you agree to install and maintain compliant Age Verification software meeting the requirements of all applicable laws in your jurisdiction, including but not limited to US state AV laws (Florida, Texas, Utah, and others), the UK Online Safety Act, and EU requirements. Automate Horizon reserves the right to take any site offline immediately if explicit content is found without compliant AV gates in place.
c. Artistic content vs. explicit content: You acknowledge sole legal responsibility for correctly classifying your content as artistic, non-explicit, or sexually explicit. Misclassification that results in explicit content being published without AV gates constitutes a breach of these Terms and grounds for immediate suspension.
d. Lead forms and marketing communications: Information submitted via booking forms or contact forms may be used for consultation and business communication. You may opt out of marketing communications at any time.
7. 18 U.S.C. § 2257 Record-Keeping
If your site produces, displays, or distributes sexually explicit content as defined under 18 U.S.C. § 2257, you are the primary producer of that content. You are solely responsible for creating, maintaining, and making available the records required under 18 U.S.C. § 2257 and 28 C.F.R. Part 75, including age verification records for all performers.
Automate Horizon is not a producer of your content and bears no responsibility for your 2257 compliance. Failure to maintain compliant records constitutes a breach of these Terms and grounds for immediate termination of your account.
8. FOSTA-SESTA & Prohibited Activities
a. Zero tolerance for in-person services: Automate Horizon strictly prohibits use of our platform to promote, advertise, facilitate, or book any in-person sexual service. This includes:
- Prostitution, escorting, or any exchange of sexual acts for money or goods.
- In-person BDSM or domination sessions, professional dungeon rentals.
- In-person voyeurism or pay-to-attend live sexual events.
- Unlicensed erotic massage or similar services.
b. Digital content only: We support legal digital content creation: selling videos, photos, custom clips, and subscriptions. Any content, text, or metadata on your site that suggests, hints at, or offers a physical meeting, in-call, out-call, touring schedule, or live in-person session constitutes a breach of these Terms regardless of how it is framed.
c. Immediate termination: Sites found using our platform to facilitate physical solicitation will be suspended immediately without refund. We will report to relevant authorities where required by law. This policy exists to comply with the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA) and Stop Enabling Sex Traffickers Act (SESTA).
d. Governing law: You agree that your use of our services complies with all applicable local, state, federal, and international laws.
9. Hosting, Infrastructure & Security
a. Managed infrastructure: Your site runs on Automate Horizon’s managed WordPress multisite infrastructure. We install and maintain enterprise-grade security software including web application firewalls, malware scanners, and anti-DDoS protection across the network. We reserve the right to perform WordPress core updates, PHP version upgrades, and security patches without prior notice.
b. Network integrity: Automate Horizon reserves the right to suspend any site that poses a risk to network security, performance, or legal compliance, including but not limited to sites under active DDoS attack, sites found hosting malware, or sites in breach of these Terms.
c. No disabling security tools: You may not disable, bypass, or obstruct any Automate Horizon security software, age verification gates, or platform monitoring tools. Doing so constitutes grounds for immediate suspension.
d. Automated provisioning: By subscribing, you acknowledge that your site is provisioned automatically on our infrastructure. You accept that minor configuration differences from a fully custom install may exist and do not constitute a defect in service.
e. Limited liability for updates: While we take all reasonable care during maintenance, Automate Horizon is not liable for minor visual disruptions or configuration reverts that may occur during necessary security patching.
10. DMCA & Content Takedowns
Automate Horizon respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512).
If you believe content on an Automate Horizon-hosted site infringes your copyright, send a written notice containing: (1) identification of the copyrighted work; (2) identification of the infringing material and its URL; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; and (6) your signature.

You agree to indemnify Automate Horizon against any claims arising from content you publish on our platform that infringes a third party’s intellectual property rights.
11. Data Processing
When your site collects personal data from your visitors or subscribers (including email addresses, payment information processed by CCBill, and form submissions), Automate Horizon acts as a data processor in respect of that data, and you act as the data controller. You are responsible for ensuring that your collection and use of visitor data complies with all applicable data protection laws, including the UK GDPR, EU GDPR, and relevant US state privacy laws.
Our collection and use of your data as a subscriber is governed by our Privacy Policy.
12. Email Marketing (Horizon Mail)
If you use the email broadcasting features of the Service (referred to as "Horizon Mail"), the following terms apply. Email marketing carries legal obligations under the US CAN-SPAM Act and equivalent laws. You are responsible for compliance regardless of where your subscribers are located.
a. You are the sender. You are the CAN-SPAM "sender" of every email sent from your account. Automate Horizon acts as your service provider and mailer at your instruction. You retain full responsibility for compliance with all applicable email marketing laws. Automate Horizon accepts no liability for your email campaigns.
b. Compliance warranty. You warrant that: (i) every subscriber on your list gave direct, prior affirmative consent to receive marketing email from you; (ii) all email content is truthful and non-deceptive; (iii) email containing sexually explicit material is labelled with the FTC-required prefix "SEXUALLY-EXPLICIT: " and sent only to subscribers who have consented to such material; and (iv) you will honour opt-out requests within 10 business days and maintain opt-out records permanently. You indemnify Automate Horizon from any claim or penalty arising from your violation of these warranties.
c. Physical postal address. You must provide and maintain a valid physical postal address for inclusion in every email footer, as required by CAN-SPAM. A PO Box or commercial mail-receiving address is acceptable. Email sending is disabled until this address is configured in your account. Do not use Automate Horizon's address: we are the service provider, not the sender.
d. Prohibited practices. You must not: send to purchased, scraped, rented, or traded lists; send to anyone who has opted out or never opted in; use deceptive subject lines or header information; include sexually explicit images or text in the initially viewable area of any email without verified prior recipient consent; or send volume above your plan's monthly quota without upgrading. Violation is grounds for immediate suspension of email features or termination of your account.
e. Platform enforcement rights. Automate Horizon may suspend, throttle, or permanently disable your email sending, without liability, if: your complaint or bounce rates exceed industry thresholds; you breach any provision of this section; our delivery partners flag your account for policy violations; or we reasonably believe continued sending creates legal or reputational risk. We will attempt to notify you before acting where practicable but may act immediately where the risk is urgent.
f. Delivery partners. Email is transmitted via our delivery partners. By using email features you agree to comply with those partners' acceptable-use policies. We do not name specific partners in these Terms as part of our white-label arrangement. Violation of a delivery partner's acceptable-use policy is a violation of these Terms.
g. Sending limits. Email volume is metered per your plan and subject to a monthly quota. Automate Horizon may refuse or throttle sends at or above your quota. Exceeding your quota requires a plan upgrade. Unused quota does not roll over. We reserve the right to adjust quota limits on 30 days notice.
h. Your subscriber data. Your subscriber list belongs to you. Automate Horizon processes it only to provide the Service and will never sell, rent, or share it with third parties except as required for delivery. Opt-out records are never transferred. You may export your list at any time from the Studio dashboard.
13. Indemnification
You agree to indemnify, defend, and hold harmless Automate Horizon, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or connected with:
- Your use of the platform or services.
- Your violation of these Terms.
- Your content, including any claim that it infringes a third party’s rights or violates age verification or 2257 laws.
- Your violation of any applicable law or regulation, including email marketing laws.
14. Disclaimer
Our services are provided on an ‘as is’ basis. Automate Horizon makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free service.
15. Limitation of Liability
To the fullest extent permitted by law, Automate Horizon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of or inability to use the platform. Our total liability to you for any claim shall not exceed the subscription fees paid by you in the three months preceding the claim.
16. Third-Party Links
Our site may contain links to third-party websites. Automate Horizon is not responsible for the content, privacy practices, or accuracy of any linked site. Links do not constitute endorsement.
17. Modifications to These Terms
We may update these Terms at any time. For material changes, we will notify active subscribers by email at least 14 days before the change takes effect. Continued use of the platform after that date constitutes acceptance of the updated Terms. The current version is always available at automatehorizon.com/terms-of-service/.
18. Governing Law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nashville, Tennessee.
