Automate Horizon may revise these Terms & Conditions without notice. By using this website or services, you agree to the current version of these terms.

8. Payment Gateways

a. Payment Gateway Applications and Transactions: To ensure stability and prevent account freezes common in high-risk industries, Automate Horizon mandates the use of specific payment gateways (primarily CCBill) for client storefronts. By using our services, you agree to adhere to the gateway requirements outlined in our Security & Compliance Policy.

b. Gateway Approval: You acknowledge that your application for payment gateways is subject to the provider’s underwriting process. The decision to approve or deny your application rests solely with the provider (e.g., CCBill) and is beyond our control. Denial of a gateway account does not constitute grounds for a refund of Automate Horizon development fees.

c. Alternative Payment Methods: In the event that a gateway application is denied, we offer options to process payments through alternative peer-to-peer providers where applicable.

d. Manual Payment Processing: Please note that our systems allow payments to be initiated by the customer at checkout. However, in certain circumstances, additional manual tasks may be required from you to ensure your order is processed.

e. Limitation of Liability: We are not responsible for any delays, denials, or other issues arising from third-party payment gateway providers.

9. Refunds & Cancellations

All purchases, subscriptions, and service engagements are subject to our dedicated Refund & Cancellation Policy.

a. Summary: Refunds for incomplete orders or pre-development services are eligible before build work begins. Third-party costs and delivered services are non-refundable.

b. Processing: Approved refunds are typically processed within 7 business days. Please review the full policy for specific details regarding SaaS products vs. Website development services.

10. Content, Compliance, and Age Verification

a. Adult Content & Age Verification: Clients operating websites featuring sexually explicit or restricted content strictly agree to comply with all applicable Age Verification (AV) laws in their jurisdiction (including but not limited to U.S. State laws, UK, and EU regulations).

b. Mandatory AV Software: If the Client chooses to host explicit content, they agree to install and maintain active Age Verification software. Automate Horizon reserves the right to take any website offline immediately if it is found to be displaying explicit content without compliant Age Verification gates.

c. Distinction of Content: The Client acknowledges they have full creative control over their content. However, the Client assumes full legal liability for distinguishing between “Artistic Nude” and “Sexually Explicit” (which requires AV). Automate Horizon will enforce compliance regarding laws and web standards regarding nudity.

d. Lead Forms and Calendar Data: Information collected via lead forms and calendar systems is used for consultation, account support, and business communication. By submitting these forms, you acknowledge that Automate Horizon may send you relevant marketing communications, including free guidance, compliance tips, and promotional offers regarding our products and services. You may opt-out of these marketing communications at any time.

11. Hosting, Maintenance, and Security Updates

a. Mandatory Security Maintenance: To ensure the safety of our network and client data, Automate Horizon installs and manages enterprise-grade security software (such as Web Application Firewalls, Malware Scanners, and Anti-DDoS protection) on all hosted sites. We reserve the right to perform critical “Back-End” updates, including WordPress Core updates, PHP version upgrades, and security patches. We reserve the right to select or change specific security software vendors at our discretion to meet current threat levels.

b. SEO & Utility Software: We provide premium tools to handle search engine indexing and metadata management. The specific software used for these functions is subject to change based on performance and licensing requirements. Disabling these tools or the security software mentioned above is strictly prohibited unless the site is formally transitioned to “Self-Managed Status.”

c. Agency Licenses: All premium software, themes, and plugins included in our services are provided under Automate Horizon’s agency licenses. You do not own these licenses. If you cancel your subscription, transfer your hosting away, or move to “Self-Managed Status,” you are responsible for purchasing your own individual licenses to maintain premium functionality.

b. Limited Liability for Updates:While we take all reasonable care during updates, Automate Horizon is not liable for minor visual disruptions or setting reverts (such as metadata or plugin configurations) that may occur during necessary security patching.

c. Right to Suspend for Non-Compliance: If a Client obstructs or disables critical security measures (including Firewalls or Age Verification software), Automate Horizon reserves the right to immediately suspend hosting services to protect our infrastructure and other clients.

12. Self-Managed Hosting & Isolation (Unmanaged VPS)

Clients who wish to opt-out of Automate Horizon’s standard security and maintenance protocols may do so by requesting “Self-Managed Status.” The Client acknowledges that this is an Unmanaged Service and agrees to the following:

a. Provisioning & Handoff: Automate Horizon will provision an isolated Virtual Private Server (VPS) and provide the Client with the raw website files and database export. The Client is solely responsible for the migration, installation, and configuration of these files onto the VPS.

b. Technical Responsibility: The Client acknowledges that managing a VPS requires Intermediate to Advanced technical knowledge, including familiarity with Linux-based operating systems, command-line interface (CLI), and database management. The Client will be granted Root/Administrative access and assumes full control over the server environment.

c. Scope of Service: Automate Horizon provides the server infrastructure only. We will take no action to manage, maintain, update, back up, or secure the server operating system or the website application.

d. Costs & Risks: This hosting option incurs higher monthly fees due to the isolated infrastructure. Automate Horizon is not responsible for any security breaches, data loss, hacking incidents, or payment gateway failures (e.g., CCBill) resulting from the Client’s management of the server.

13. Indemnification

The Client agrees to indemnify, defend, and hold harmless Automate Horizon, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: 

  • The Client’s access to or use of the Services; 
  • The Client’s violation of these Terms; 
  • The Client’s violation of any third-party right, including without limitation any intellectual property, publicity, confidentiality, property, or privacy right; 
  • Any claim that the Client’s content caused damage to a third party or violated Age Verification laws.

14. PROHIBITED ACTIVITIES, NO SOLICITATION & GOVERNING LAW

a. Zero Tolerance for In-Person Services (FOSTA/SESTA Compliance): Automate Horizon strictly prohibits the use of our services for the promotion, booking, facilitation, or advertising of any in-person sexual services. This includes, but is not limited to:

  • Prostitution & Escorting: Any exchange of sexual acts for money.
  • “Sessioning” & Dungeons: In-person BDSM sessions, domination/submission play, or professional “dungeon” rentals.
  • In-Person Voyeurism: selling tickets or access to physically watch sexual acts or BDSM scenes in person (e.g., “Pay-to-View” live events).
  • Massage Services: Unlicensed erotic massage or “Happy Ending” services.

b. Digital vs. Physical Distinction: We support legal digital content creation (selling videos, photos, and custom clips). However, any content or text on the website that suggests, hints at, or offers a physical meet-up (e.g., “Touring schedules,” “Booking In-calls/Out-calls,” “Real-life meetings”) constitutes a violation of these Terms.

c. Immediate Termination: If a website is found to be using our tools to facilitate physical meet-ups or solicitation, hosting will be terminated immediately without refund, and the Client will be reported to relevant authorities if required by law. This policy is enforced to comply with federal laws (including FOSTA/SESTA in the USA) and Payment Gateway regulations.

d. Governing Law: Automate Horizon strictly adheres to all local, state, and federal laws. Users are responsible for ensuring their use of our services complies with all applicable legal standards.
